By accessing or using BooOrBae ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

By proceeding, you confirm that you understand this is an ENTERTAINMENT APP with NO guarantees of accuracy, and you will NOT hold us responsible for any results or consequences.

2. Eligibility

BooOrBae is an AI-powered mobile application that analyzes conversation screenshots and videos to provide relationship insights. The App uses:

  • AI Vision Analysis: Google AI for direct visual processing of screenshots and videos

4. User Responsibilities and Content Ownership

4.1 Content You Upload

IMPORTANT: By uploading a screenshot or any content to the App, you represent and warrant that:

  • ✅ You own all rights to the uploaded content, OR
  • ✅ You have obtained all necessary permissions and consents from all parties whose content appears in the screenshot

4.2 Third-Party Privacy

⚠️ WARNING: Screenshots of conversations typically contain private messages from other people. Analyzing such content without their explicit consent may violate privacy laws including GDPR, CCPA, and KVKK.

You are solely responsible for ensuring you have the legal right to upload and analyze any content containing information about third parties.

5. Prohibited Uses

You agree NOT to use the App for:

  • ❌ Stalking, harassment, or intimidation of any individual
  • ❌ Violating someone's privacy without their knowledge or consent
  • ❌ Sharing or distributing others' private messages without permission
  • ❌ Any illegal, harmful, or unethical purposes
  • ❌ Impersonating another person or entity
  • ❌ Uploading content you do not have rights to
  • ❌ Attempting to reverse-engineer or hack the App

Violation of these prohibited uses may result in immediate account termination and potential legal action.

6. AI-Generated Content Disclaimer

6.1 Not Professional Advice

  • The analysis provided by BooOrBae is AI-generated and for entertainment and informational purposes only
  • This is NOT professional relationship counseling, therapy, or legal advice
  • Results may not be 100% accurate
  • You should not make life decisions solely based on AI analysis

6.2 AI Accuracy Limitations

  • AI models can misinterpret context
  • Results are based on pattern recognition, not human understanding
  • Different inputs may produce different results
  • The App does not guarantee accuracy or completeness of analysis

8. Subscription and Payment Terms

  • 25 free screenshot analyses on signup
  • 25 free video seconds on signup
  • One-time welcome bonus (does not reset)

8.2 Premium Tier ($9.99/month or $79.99/year)

  • 300 screenshot analyses per month
  • 300 video seconds per month
  • Premium-only features and detailed insights
  • Automatic renewal unless cancelled

8.3 Refund Policy

  • No refunds for partially used subscription periods
  • You may cancel anytime to avoid future charges
  • Cancellation does not entitle you to a refund for the current billing period

9. Intellectual Property

All intellectual property rights in the App, including but not limited to software code, design, logos, trademarks, and AI models, are owned by BooOrBae or its licensors.

You retain ownership of the content you upload. However, by uploading content, you grant BooOrBae a limited, non-exclusive, worldwide license to process your content for AI analysis and improve our services.

10. Termination

You may delete your account at any time through the App settings.

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You engage in prohibited uses
  • You abuse the service
  • We are required to do so by law

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of AI analysis
  • Uninterrupted or error-free service

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

BooOrBae, its officers, directors, employees, and agents SHALL NOT BE LIABLE for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Service interruptions or errors
  • Actions you take based on AI analysis
  • Violations of third-party privacy caused by your misuse

MAXIMUM LIABILITY: Our total liability to you for any claims shall not exceed the amount you paid to us in the past 12 months (or $100, whichever is less).

13. Indemnification

You agree to indemnify and hold harmless BooOrBae from any claims, damages, losses, or expenses (including legal fees) arising from your use or misuse of the App, your violation of these Terms, or your violation of third-party rights.

14. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the United States without regard to conflict of law principles.

Any disputes arising from these Terms or the App shall be resolved through binding arbitration. You agree to resolve disputes individually and waive your right to participate in class actions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.
